Booking a first aid course or purchasing a product from New Zealand Red Cross? Here are our terms and conditions of sale.


New Zealand Red Cross prides itself on selling well-priced, high quality merchandise.

Our AED products come with comprehensive manufacturer warranties. Please contact us if you would like further details.Should other products not meet your expectations they may be returned unopened (in as-new condition) within 7 days for a full refund of the purchase price.If you are at all dissatisfied with your purchase please contact us as soon as is practicable on 0800 RED CROSS (0800 733 276) or send us details of your concern.

Products will only be dispatched after payment has been received, unless prior arrangements have been made with New Zealand Red Cross.

Courses may be cancelled or rebooked in certain circumstances.

Please call us as soon as possible on 0800 RED CROSS (0800 733 276) should you need to change your booking.

Unless expressly altered or modified by New Zealand Red Cross, the following terms and conditions apply and shall be deemed incorporated in, and form part of the acceptance by New Zealand Red Cross of the Purchaser's order.

Payment

Goods will be charged at the current website price at the date of the order, unless agreed otherwise with New Zealand Red Cross.Goods may not be dispatched, and remain the property of New Zealand Red Cross, until payment has been received.If the Purchaser does not pay the amount owing by its due date, New Zealand Red Cross may charge the Purchaser interest, at rates equal to the overdraft lending rate charged by New Zealand Red Cross' bank and any discounts may be disallowed. The Purchaser is liable for all costs incurred in the collection of overdue amounts.

Course cancellation and refund policy

We guarantee to refund fees when:

The course is cancelled or discontinued by New Zealand Red Cross.

The participant has a verifiable reason for discontinuing the course, e.g. medical.

Notification is received at least 3 working days before the course starts.

Product delivery

Should product not be available to fulfil an order New Zealand Red Cross reserves the right to cancel the order in part or full. Any payment received for goods unable to be delivered will be refunded in full.New Zealand Red Cross shall not be responsible or liable in any way to the Purchaser for default or delay in delivery of any part of the order nor for any direct or consequential damage or loss arising from any such default or delay. Delay or default in delivery does not entitle the Purchaser to cancel any order.Risk of any loss, damage or deterioration of or to the goods passes to the Purchaser on delivery in accordance with delivery instructions.

Product guarantees and conditions - consumers

New Zealand Red Cross does not provide any express guarantees (as defined in the Consumer Guarantees Act 1993) other than those expressly confirmed by New Zealand Red Cross in writing.Nothing in these terms and conditions is intended to have the effect of contracting out of the provisions of the Consumer Guarantees Act 1993 except to the extent permitted by that Act, and these terms and conditions are to be modified to the extent necessary to give effect to that intention.

Product guarantees and conditions - goods purchased for business purposes

The provisions of the Consumer Guarantees Act 1993 do not apply if the goods are being purchased for business purposes.  

The liability of New Zealand Red Cross to the Purchaser shall not in any case exceed the purchase price of the Goods in respect of which such liability arises.

New Zealand Red Cross will have no liability for any damages or consequential loss to the Purchaser arising from such breach.

New Zealand Red Cross will not be responsible for any damage whatsoever to the goods resulting from the malfunction of such goods where they are fitted by unqualified tradespeople; fitted in an untradesperson-like manner; in any way adapted to a use to which they are not specifically intended; and/or added to or repaired by components not recommended or approved by the manufacturer of the goods.

The Purchaser may reject defective goods by lodging a claim with New Zealand Red Cross within 7 days of receipt, quoting the order number, order date, and New Zealand Red Cross may, in its sole discretion, repair, replace or refund the purchase price of the goods. No goods are returnable after 7 days.

Use of information

The Purchaser unconditionally consents to New Zealand Red Cross (including any employees, contractors, agents, advisers, related companies, and service providers of New Zealand Red Cross) collecting, storing, using and disclosing information about the Purchaser in the manner described in this clause.

New Zealand Red Cross may collect, use, and disclose information about the Purchaser to process and carry out transactions that the Purchaser has requested or authorised, and for New Zealand Red Cross's accounting, operational, statistical, and marketing purposes.

The Purchaser consents to receiving electronic messages and information sent by (or on behalf of) New Zealand Red Cross pursuant to the Unsolicited Electronic Messages Act 2007.

New Zealand Red Cross may store and retain all information that it collects about the Purchaser for as long as may be necessary at New Zealand Red Cross offices and storage facilities in New Zealand and overseas.

The Purchaser must notify New Zealand Red Cross of any change in circumstances that may affect the accuracy of the information provided by the Purchaser to New Zealand Red Cross.

If the Purchaser is an individual the Purchaser has rights to access and correction of information held by New Zealand Red Cross by phoning 0800 RED CROSS (0800 733 276).

Miscellaneous

The rights, powers and remedies provided for in these terms and conditions are in addition to, and do not limit or exclude (or otherwise adversely affect), any right, power or remedy provided to New Zealand Red Cross by law.

New Zealand Red Cross reserves the right to review any of these terms and conditions at any time and from time to time. If, following any such review, there is any change to these terms and conditions that change will take effect from the date on which New Zealand Red Cross gives notice to the Purchaser of such change.

References to the Consumer Guarantees Act 1993, Unsolicited Electronic Messages Act 2007 and the Privacy Act 1993 include that legislation as it is from time to time amended, reenacted or substituted and any statutory instruments, regulations and orders issued under such legislation.
